				<content:encoded><![CDATA[<p><strong>1.  Not understanding  what’s covered under warranty.</strong><br />
As the new homeowner it is your responsibility to understand was is covered under warranty.  When you take possession of your new home your builder must give you a <em>Homeowner’s Information Package</em>.  Read it! It has very important warranty information inside including;</p>
<ul>
<li>The statutory warranties that apply to all new homes in Ontario.</li>
<li>The responsibilities of homeowners, builders and Tarion.</li>
<li>The process used by Tarion to handle warranty claims.</li>
</ul>
<p><strong>2.  Filling out Tarion forms incorrectly</strong><br />
You can only submit one 30-day and Year-End form, so make sure it is correct and complete.  Make sure you filled out the entire form properly including date of possession, builder number, enrolment number and lot numbers.  Provide a complete list of areas of concern.  When in doubt if an item is warrantable or not we suggest you list it and let Tarion decide.</p>
<p><strong>3. Using the wrong statutory forms</strong><br />
You must use the forms provided by Tarion or they will not accept your warranty claims.  You must also use the appropriate forms, for example you cannot use the 30-Day or Year-End forms in your second year of ownership.  You must use the Second-Year form.</p>
<p><strong>4. Submitting forms too late</strong><br />
This is another common mistake.  Tarion has timelines of when you can submit your warranty forms, so you must follow them.  For example if you don’t submit your 30-Day form within the first 30 days of ownership, the next time you can notify Tarion of any outstanding issues is within the last 30 days of your first year of ownership.  Those items now have to be included on your Year-End form.</p>
<p><strong>5. Not maintaining the house properly which could void warranty claims.</strong><br />
By conducting proper maintenance on your home will insure your warranty rights are protected.  Tarion has included a home maintenance check list which is included in your Homeowner Information Package.  You should ask your builder about maintenance during the Pre-Delivery inspection.</p>
